By submitting art you are agreeing to allow Inked to use the images you submit online and in the magazine while your art is offered for sale and agree to the following terms and conditions. You retain copyright to art that is submitted to Inked.
YOUR OBLIGATION
In consideration of your use of the Service, you agree to:
(a) Provide true, accurate, current and complete information about yourself as promoted by the Service's registration form (such information being the "User Profile Data") and
(b) notify or remove any art that is submitted that is subsequently sold directly or by a third party and
(c) Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue or inaccurate or Inked has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Inked has the right to suspend or terminate your registration and refuse any and all current or future use of the Service (or any portion thereof).
In addition, you certify that you own all rights, including copyrights of all submitting materials provided to www.inkedmag.com. In accordance with this Agreement, you authorize www.inkedmag.com:
(a) the right to display images of your art works and related information online and in the magazine
(b) the right to sell your art work(s) if you wish.

This site is protected by the Copyright laws of the United States of America any copy, reproduction, modification, distribution, display, or retransmission of all or any of the contents of this site is strictly prohibited without prior written consent.
IN GENERAL
1. www.inkedmag.com reserves the right to reject submissions if we feel that the artwork submitted is in appropriate or violates copyright laws.
2. www.inkedmag.com reserves the right to keep, delete and edit descriptions with the artists consent.
3. www.inkedmag.com will protect the artists copyright to the best of s abilities but assumes no responsibility for the use of art worked displayed at HYPERLINK "http://www.inkedmag.com" www.inkedmag.com by third parties.
4. www.inkedmag.com charges a 10% commission on all sales made through www.inkedmag.com.
5. www.inkedmag.com does not permit users' contact information to be posted on site.
6. www. inkedmag.com makes no representations or warranties of any kind as to:
(a) the accuracy or completeness of the information or materials contained in this site, and assumes no responsibility for any errors or omissions in the content of this site (which may include factual or typographic errors and/or technical inaccuracies);
(b) the presence or absence of computer bugs or viruses which third parties may imbed in or attach to this site without www.inkedmag.com's knowledge;
(c) the merchantability or fitness for use of any of the artwork displayed;

PAYMENT OF ROYALTY
Commission Rate
For all Artists, Art Galleries, Art Organizations and Others who wish to sell their artwork through Inked Magazine
When sales occur, Inked will deduct a commission of 10% from the final sale price of all art sold.
Inked will then pay the difference to the artists, art galleries, art organizations or correspondence parties within 10 days of the buyer confirmation of receipt of merchandise. With each royalty payment, Inked will provide artists, art galleries, art organizations or correspondence parties with a receipt listing the calculation of the amount of the royalty payment and buyer information.
*Note: Inked Magazine authorizes HYPERLINK "http://www.PayPal.com" www.PayPal.com, a secure on-line payment processing company to handle all Inked on-line payments.
AMENDMENT
Inked reserves the right to modify, amend or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Inked shall not be liable to you for any modification, suspension or discontinuance of the Service.
TERMINATION
You agree that Inked Magazine, in its sole discretion, may terminate your use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if Inked believes that you have violated or acted inconsistently with our terms and agreement. Inked may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of the Agreement may be effected without prior notice, and acknowledge and agree that Inked may immediately deactivate or delete your personal page and all related information or the Service. Further, you agree that Inked shall not be liable to you for any termination of your access to the Service.
You may terminate your relationship with Inked at anytime and in your sole discretion by requesting that your submissions be removed from the site or by removing them yourself at anytime.
FOR INTERNATIONAL USE
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.
APPLICABLE LAW
These Terms & Conditions agreement shall be governed by the laws of the State of New York.
